IV. Scope

This policy applies to all Marymount University personnel: administration, faculty, and staff.

V. Purpose

The purpose of this policy is to establish consistent guidelines for the creation, management, retention, and disposal of university records to ensure compliance with legal, regulatory, and operational requirements. This policy supports the preservation of essential university records, promotes efficient recordkeeping practices, and ensures timely and secure disposal of records when appropriate. It applies to all formats of records (physical, electronic, or otherwise) created and maintained in the course of university operations and serves to protect the University’s legal and administrative interests.

VI. Policy Statement

Records, regardless of format, created in the course of business, are the property of Marymount University (MU) (“University”).  MU offices and staff that create and maintain these records are responsible for their preservation and security while they are in active use, and are also responsible for consulting the records retention schedule to determine when and how inactive records should be stored or destroyed.  

VII. Policy

Records Retention

The Records Retention Schedule is a guideline that sets forth the length of time records are recommended to be retained. This guideline applies to all records listed on the schedule to the extent they are maintained by the University, including storage areas. The schedule is intended to cover all University records for which there is a legal, regulatory or management retention requirement. 

Records Disposal

Records may not be destroyed unless permission is granted through an approved records schedule. Prior to disposal, departments must complete and submit the University’s official Records Destruction Form to the Office of General Counsel for review and approval. Records pertaining to any investigation, legal action, or proceeding, litigation, audit, or program review in progress must not be destroyed even if the retention period or disposition date specified for the records has expired. Document destruction will be suspended immediately, upon any indication of an official investigation or when a lawsuit is filed or appears imminent. Destruction will be reinstated upon conclusion of the investigation.

Access to Records

Access to records remaining in the custody of academic units and offices is through a designated staff person. Access to records in the custody of the University is in accordance with its policies and procedures. Some materials may be restricted if there are privacy and/or confidentiality concerns.

Digital or Electronic Records

Disposition of records created, retained, or stored in information systems or computers should proceed on the same basis as traditional records. Digital or electronic records for which there is no retention requirement should be deleted promptly.

IX. Compliance

Failure on the part of employees to follow this policy can result in possible civil and criminal sanctions against the University and its employees and possible disciplinary action against responsible individuals.

The Office of General Counsel will periodically review policy, schedules, and procedures to ensure that they are in compliance with new or revised regulations and best practices.
